You’re taking a risk anyway if you win 50k at the casino and walk out of there with it all in cash. I don’t see why you would. Personally, I’d be looking over my shoulder the entire time.

Not saying I agree with asset forfeiture. I just don’t like the example. Yes, what belongs to you should remain yours, barring the direct judgements of a court.

A temporary seizure just might be appropriate in some situations. But any seizure should come with a law that says that a criminal prosecution directly connected to the property seized must commence with “x” number of days (perhaps 15...or maybe 30) of the seizure or the property seized must be returned. And if a prosecution is initiated a conviction must occur or else the seized property must be returned.

Louisiana along I-10. One of the major Tv news magazines did a story on it after huge numbers of complaints. Troopers would pull over Cadillacs, etc with out-of-state tags, claim any money they had was drug money and seize all money and often the car.

There should be no civil asset forfeiture at all.

The laws provide for fines and punishments ... on conviction there should be nothing beyond those. If the fines aren’t adequate then increase them.
