I’m sure there are lawyers here who will disagree, but on balance the courts use the “standing” issue and the issue of letting cases ripen (at the appeals level) to delay or deny justice, not to pursue it. In this election cycle we have seen a court rule that a case is filed too early before the election has taken place and then have the same petition denied after the election because the petition was filed too late, under the laches doctrine.

I tend to think that Kavanaugh and Barrett were corrupt under the surface, knew their roles and played them to please their masters behind the curtain - sort of like silent running submarines. The Roberts court has succeeding in destroying an already fragile credibility of the Supreme Court. They are now simply part of the Praetorian guard for tyranny and tyrants.

Mitch McConnell played an very active role in putting forth the supreme court nominees, this outcome shouldn’t be much of a surprise at this point.
