Under current law, the power to appoint McConnell’s replacement falls to Democratic Gov. Andy Beshear. But new legislation McConnell is pushing in the Kentucky General Assembly would strip the governor of that power and put it into the hands of the state GOP.

The Republicans hold a veto-proof majority in Kentucky, so they could override a veto by the Democrat governor. I wonder what the Kentucky constitution says on this issue. I imagine it would be a tough fight in the courts.

Beshear owns the state supreme court. I don’t know that it would end up in the federal system.
