I’m no legal scholar or a top expert on constitutional law, so can someone show me where in the US Constitution there are provisions punishing American enterprise for hiring Americans?
You won’t find it in the constitution but Federal law, which should protect Americans and their right to work, has a workaround and Biden aims to use it.
According to a CNBC report Joe Biden is using the DOJ to make an example out of Elon Musk by publicly harassing him with Federal litigation because SpaceX “hires too many” US citizens and not enough non-resident foreign workers.

Back in the early 2000’s, I experienced the undeniable fact that companies were hiring non-Americans rather than Americans. Who was behind that effort? Who is paying who to promote that movement?
It’s downright savage the way the Republicans have all gotten on the same page on this, got their talking points out, and are hammering the Biden Administration on this obviously unpopular (if anyone was to hear about it) move against the American people. Sarcasm. The Republicans probably agree with it.
Every aerospace company tells you right on their website that you have to be a “US Person” for access to ITAR information or actually classified information in order to work there.
Only a Mexican nationalist like Lisa Sandoval would attempt to go after them for holding to that.
Discrimination against someone based on national origin is only prohibited if they are already a “US Person”.
In the case of companies building missiles, it’s called “sensible restriction”. There are no H1-B rocket engineers for a reason.
I expected the Biden Administration to go after Musk with environmental laws like banning a key substance needed to make a Tesla work. I didn’t expect that not hiring foreign workers would be an attack. It just goes to show you how messed up things have gotten. Following the law gets you in trouble.
After passing all these orders to buy electric cars coming out, what would happen if Tesla closed its US operations and only sold to non-US locations. Sort of an Ellis Wyatt move.

He is obligated under the federal contracts he signed to do that, now they want to sue him??? How does any of this make sense??

The DOJ’s Immigrant and Employee Rights Section received a complaint of employment discrimination from a non-U.S. citizen claiming that the company discriminated against him based on his citizenship status.“The charge alleges that on or about March 10, 2020, during the Charging Party’s interview for the position of Technology Strategy Associate, SpaceX made inquiries about his citizenship status and ultimately failed to hire him for the position because he is not a U.S. citizen or lawful permanent resident,” DOJ attorney Lisa Sandoval wrote in a court document filed Thursday. The document was a request for a judge to order SpaceX to comply with an administrative subpoena for documents related to how the company hires.
Not a citizen and not a lawful permanent resident means not eligible for work in the U.S.
It also means not being able to clear a background check, which is probably required for a lot of SpaceX's work with the Government.
You can still be here on a temporary work visa and be allowed to work.
Oh goodness no. After all her investment, if Biden did anything to Tesla, Pelosi would have him 25thed so fast his head would spin.
You can only get a temporary work visa if there aren't enough U.S. citizens or permanent residents to fulfill the positions available.
That means the company must first exhaustively search for legal U.S. citizens and permanent residents for a position, and only after none are found can they then interview non-resident aliens for the position and sponsor them for an H-1B visa.
It doesn't mean that non-resident aliens get to apply for any job they want and then expect to receive a temporary work visa.
