It’s already sidetracked by Biden’s absence of political capital. His popularity is below Trump’s today, and his foolishness with the National Guard, sleeping in the parking garage on a 34 degree night with 2 porta-pottys for hundreds of soldiers -— this will not go away quickly.

I can’t believe that the Biden Administration will be this incompetent already. Especially since they were quite cunning on their way to seize power in the White House. I guess we will find out shortly.

You’re right that Trump was impeached while President, and the Constitution says that “The Senate shall have the sole power to try all impeachments.” Though I don’t think they even considered a last-minute impeachment, the writers didn’t say that the Senate is “required” to try all impeachments. Most important, though, note the exact wording of the penalty part:
“The Senate shall have the sole Power to try all Impeachments...Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States...” [Constitution Article 1 Section 3]
It doesn’t say removal from office “OR” disqualification to hold office. It says “AND”. That makes me think that it was intended for trying persons still in office. Trump, no longer being President, cannot be removed from office, therefore the penalties can’t be applied. (There’s a comma before the “and”, but I doubt that it makes “and” equivalent to “or”, allowing the second part to be substituted for the first. I think, at most, it means that the second part may or may not be added to the first.)

Well I think it could be argued that without election fraud there would have been no protest, so proof must be shown of the fraud.
To the extent there was a riot it was caused by Antifa.
I was just throwing that out there myself. There are rumors that Obama pardoned Joe, Hunter, himself, Hillary, and other officials and sealed them because of national security. Why else are none of them in jail and the FBI didn’t do anything with the laptop or Biden’s Ukraine bribes. Maybe legally they couldn’t pursue those crimes Pardons are absolute. IF those rumors are true then it would be logical for Trump to pardon himself and other people in his administration to keep congress and the deep state from putting any of them in jail.
