Last night, I spent more than hour studying the "Electoral Count Act of 1887."

If that Act gives the Vice President the final authority to count some Electoral Votes and to exclude other Electoral Votes, I cannot find the language in the statute.

Are there other statutes or decisions that grant this authority?

Based on my own limited research, Pence's decision not to exclude some Electoral Votes appears to be justified.

the issue i believe is that the act seeks to modify the constitution, but without a constitutional amendment, which allegedly makes the act unconstitutional and invalid.

My research lead me to agree with what you found. It's pretty clear what the VP could and could not do. Sure there have been marginal "theories" but nothing on solid legal ground. Pence did all he could do. Cruz too.

I do wish there hadn't been an incursion at the capitol to give them cover to avoid hearing the challenges. Or to let slimy folks like Kelly Leoffler off the hook. Her "plan to challenge" GA, announced at the Dalton, GA, even didn't even survive 24 hours.

They wanted violence and I've been predicting false flag fueled violence at the 1-6-21 rally for awhile. It's how the Left rolls. The tens of thousands who turned out peacefully we not be remembered. Instead we're all being pressured to denounce Trump, denounce MAGA and embrace the coming "reset" to socialist globalism and we better not stray from "approved" thoughts!
