I read on another thread that the Austin PD said that the rifle had not been fired. Hard to find out the facts.

Doesn’t matter. If it had been pointed at the auto driver, he has sufficient cause to use lethal force in self defence.
Further: Use the subjectivity against the keft. “He had an AW. Only murderers carry such weapons of war. I felt threatened.”
