Judge Emmett Sullivan Hires High-Powered DC Attorney to Fight Flynn Mandamus Case in Appeals Court

D.C. federal Judge Emmett Sullivan has hired Beth Wilkinson, a high-powered attorney from the D.C. establishment, to represent him in the Court of Appeals case seeking a writ of mandamus filed by Sidney Powell, the attorney for former Trump National Security Advisor Lt. Gen Michael Flynn (Army Ret.). Powell is seeking to have the appeals court block Sullivan’s efforts to prolong the Flynn case in the face of a motion by the Justice Department to dismiss the with prejudice and to have Sullivan removed form the case. In a stunning move, Sullivan had previously announced the appointment of former federal judge John Gleeson to act as an amicus opposed to the DOJ’s dismissal of the Flynn case–in a sense appointing his own prosecutor to continue the case.

Flynn had pleaded guilty to lying to the FBI and was awaiting sentencing but has since changed attorneys and moved to withdraw his plea with the new hire Powell exposing government efforts to set-up and entrap Flynn, cover-up evidence exonerating Flynn and threaten Flynn’s son with malicious prosecution. The DOJ recently moved to dismiss the case with prejudice after the revelations of massive misconduct were exposed.

Sullivan is at least the second federal judge Wilkinson has represented. Last year Wilkinson defended Judge Brett Kavanaugh in his Senate confirmation hearings for his Supreme Court nomination where he was falsely accused by Christine Blasey Ford and others of sexual assault in his high school and college years.

The Washington Post reported Saturday on Sullivan’s latest move (excerpt):

The federal judge who refused a Justice Department request to immediately drop the prosecution of former Trump adviser Michael Flynn has hired a high-profile trial lawyer to argue his reasons for investigating whether dismissing the case is legally or ethically appropriate.

In a rare step that adds to this criminal case’s already unusual path, U.S. District Judge Emmet G. Sullivan has retained Beth Wilkinson to represent him in defending his decision to a federal appeals court in Washington, according to a person familiar with the hire who spoke on the condition of anonymity because of the sensitivity of the matter. The U.S. District Court of Appeals for the D.C. Circuit is now examining the judge’s actions and the larger case against Flynn after lawyers for Trump’s former national security adviser asked the court to force Sullivan to toss Flynn’s guilty plea.

Wilkinson, known for her top-notch legal skills and get-results style, is expected to file a notice with the court in the coming week about representing the judge. She declined to comment when reached Friday evening. Sullivan also declined to comment through his office.

The appeals court, I suspect, will refuse to hear Wilkinson. They didn't ask for Wilkinson's legal reasoning, but Judge Sullivan's. And this isn't a trial where someone is entitled to representation.

If Sullivan cannot defend his position himself he's incompetent and should resign or be impeached.

Funny how the Appeals Court directed Sullivan to respond, himself, directly. They didn’t tell him to get an attorney to represent him or request additional amicus briefs to weigh in on a case about the illegal use of amici by Sullivan.

Our legal system, and legal education, are horribly broken. The overriding purpose of the legal system should be to ensure justice. It clearly isn't. I don't know how any reasonable person could think that it is.

Paedophilia is a useful blackmail tool. From many years ago the serial child murderer in Atlanta—it was a political bombshell for the excellent investigators to find out it was a pervo black perpetrator who was killing little black boys. Tough thing for the community, but generations have not forgotten how thorough and professional the PD detectives were in the care and sensitivity they expressed as well.

It is not a comfortable subject in the conservative and church /believers community— and so it is a “leverage” to have on someone— and don’t doubt for a minute what is used. This judge’s behaviour is beyond bizarre— and this serves to continue to stretch out the complete travesty in the public’s eyes and ears of the lies about Flynn, the criminal behaviour of the FBI (such that Wray is “investigating”to save his own a@@). Thanks for the info. That poor fellow has been put through it by this “State” swamp dwelling animals.

There are two decisions at bay - a district court of appeals standing precedent that a judge must accept government motion to dismiss aka Fokker and, the other, the recent SCOTUS decision authored by Ginsberg ruling against the use of Amici instead of parties (aside from the fact the law as it stands precludes amici in criminal vs. civil cases)

Judges fall under the Judicial branch of the government. AG Barr of the Department of Justice falls under the Executive branch of the government. Barr cannot “load up” on this judge anymore than the Judge can load up on Barr. Lest we forget the Government has 3 co-equal branches of government. Barr’s hands are tied in this matter. The only thing Trump can do is to pardon Flynn but if Flynn is not guilty of a crime, then the question becomes Pardon Flynn for what? Trump’s hands are tied in this matter too. What Trump did and what the DOJ has done, dropping the case, is all the Executive Branch can do. Yes it feels like Trump and Barr are helpless in this matter because they truly are. This is in the Judicial branch’s hands. The only person that can stop this is Judge Roberts of the Supreme Court who presides over all judges of the United States not just the SCOTUS. The hierarchical nature of the Judicial system is there for a reason. The left has seen to exploit that system and are well entrenched into it. It was the late 70’s going into the 80’s the left prodded the courts to see what can and cannot be done easily. You can thank the envirowhackos for that. So what we see here is the stand on the left to barr the way for conservatives (not repubes) to overcome the obstacles set up during the litigious 80’s and 90’s. Trump has been doing just that as much as he can and he has had some help from Crying Myrtle the Turtle McConnell and a few others.

There are ways to remove judges; however, only the House of Representatives can vote to impeach a judge who then must be tried by the Senate. Impeachment is not just for the President, it is for all Federally Elected officials except members of Congress. A congressman/woman may only be removed by their respective house. You cannot do a recall against a sitting Congress Critter. Only the respective members of the respective house may decide to seat or not seat or remove an elected member of Congress. Yeah you read that right. I am all for term limits but I am also for the people to be able to recall a sitting Congress critter. It is why most who roam the halls of Congress know their jobs are safe even with term limits.

But alas, keep fighting for term limits and don’t look at the removal process because if a Congress critter dos something so egregious in the constituents eye but his/her fellow comrades in arms see it otherwise (think of the many so-called Brother in arms cliques there are to protect their own) the only way a Congress critter will ever be removed is through term limits. No a viable pathway to remove a critter from Congress is to afford the power to the constituents of such Congress Critter.

However, I am under the belief that should this transpire, term limits and the ability to recall a Congress Critter, the Amendment to the Constitution that gives power to the people to elect their Senator for their state will be more than likely revoked. Thus the people will have no say, other than by fiat, to elect and remove a Federal Senator. What I mean by fiat is the original way Senators were chosen for their office, by state representatives.

Right now, Trump and Barr are regulated to the sidelines until this plays out in the courts because it has become a Judicial matter in which the Executive branch has only one way to stop this, pardon Flynn. But for what Crime, if the DOJ has dropped their prosecutorial case against Flynn.
