Let’s say I posted a tweet offering to pay anyone with a gun to shoot President Trump. Not long before the SS would be at my door with handcuffs. Then, after being held without bail in a charming place like the NYC MCC, I’d be sent to an equally lovely lace for most of the rest of my life.

Its a gravely serious threat that could well inspire some lunatic to actually do it. For that reason she should get more than a “visit” from the Secret Service. But being an insane liberal means she has nothing to fear.

It seems rather inappropriate for a teacher to use social media in order to offer money to a potential bioterrorist to kill the President. But when it’s mainstream for people to literally believe that Donald Trump is the modern-day equivalent to Hitler, can we really act surprised when people see nothing wrong with openly encouraging people to give him a deadly disease?

You will say that the unanimous 1964 Warren Court New York Times Co. v. Sullivan decision forecloses that option. However, as Antonin Scalia pointed out, Sullivan is wrongly decided. In Sullivan, Justice Brennan (along with all other justices, concurring) asserted that

". . . libel can claim no talismanic immunity from constitutional limitations. It must be measured by standards that satisfy the First Amendment”
. . . which sounds wonderful until you reflect that the sole purpose of the Bill of Rights was to assure the public that their rights were not compromised by the new Constitution. The Federalists had their fondest desire - a strong national government - within their grasp. All they had to do to keep it was to redeem their pledge to protect the rights - the existing rights of the people in the first amendments to the Constitution. Changing the rights of any person - risking controversy, just when their fondest hope was to tamp controversy down - was the furthest thing from their minds.

Accordingly the First Amendment’s protection of the freedom of the press broke no new ground, and did not override or modify laws against libel (or, FTM, pornography). Trump should sue.

And, it strikes me, the one who should really sue is Steve Scalise. Boy, can he prove damages! FTM, every Republican at that ball field can, too.
