Not the justice departments job, it is the job of the judge advocate general. This is a 100% violation UCMJ. It is not as if he was following an unlawful order, he was countermanding what was a lawful order i.e. the sole province of the President who is also CiC.
Maybe he can be a talkative rat in exchange for lighter sentencing...
