If he does emergency funding, wouldn’t this automatically go to one of our liberal circuit courts on appeal, where it could tied up in litigation indefinitely?

Maybe it could. But he can use the army corps of engineers to do some tidying up-like down near Yuma where there is a real cesspool of toxic Mexican waste running onto our side, and then simply let them start building the border wall as a result.

I don’t know if goes automatically, but if he does issue an EO and declare a state of emergency it’s going to be pretty useless if he doesn’t ignore the activist judges. I’m no lawyer, but I really can’t fathom how a state of emergency can be superseded by a wacko judge.

He might just disregard the courts. Constitutionally he could do that. Opens up a whole new can of worms though.
