BREAKING: Flynn's attorneys say they are now taking the judge up on his offer to delay today's sentencing because he's still cooperating with prosecutors.

Steven P....Judge Sullivan repeats he won't make any promises when it comes time to deliver his sentence.......NOTE -- Flynn's sentencing has not been set for March.

A status hearing, at which both sides will report the situation then in place regarding Flynn's cooperation in other cases, will occur in March.........Sullivan concludes the proceedings by wishing the parties happy holidays.

Judge says that he made a statement about Flynn being a foreign agent and that the special counsel asked for that to be corrected.

Judge says ...he was just asking a question [about treason] not suggesting Flynn committed it........

Judge now addressing what distinguishes Flynn's case from Papadopoulos and Van Der Zwaan, adding that the premise of Flynn's case is that the offense occurred in the White House.........

Judge: In not one of those cases was the defendant a high ranking government official while "in the West Wing of the White House” and lied to FBI.........
