Unless a jury hasn’t been sworn in (or the first witness seated in a judge-only trial), double jeopardy wouldn’t apply. How far did they get before she tossed it out?
About halfway through the trial, then a government whistleblower revealed the hiding of exculpatory evidence and bold face lying to the judge and other shenanigans.
And still the prosecution demands the right to continue prosecuting. I am convinced that big dollar investment interests from Las Vegas want the Bundy Ranch and their water rights and this entire charade is about bankrupting them.
Yeah, that’s the whole rationale for the double jeopardy section... to keep the government from trying you into bankruptcy. Enough of that happens during the original trial. Well, I guess nothing prevents them from going to the ninth on some “new and novel” interpretation of the Constitution. Not sure how far it’d get, though.

The fact that Sessions allows this crap to go on, wasting the taxpayers money, and persecuting citizens, tells me that Sessions thinks that .fedgov can do no wrong, that he is compromised, or that he is completely out of the loop. Probably all three.
Sessions is an sad embarrassment.
Same situation for 78 year old Dwight Hammond and his son currently imprisoned for the second time for the same “crime” by Obama’s justice department.
I wish Judge Navarro would dismiss their case with extreme prejudice.
Better yet, Trump should just pardon this man and his son.

I can’t begin to express my growing disillusionment in Jeff Sessions. Really sad that such a good man would sink this low.
The only reason Sessions is still in office is because Trump wants him there. I’ve heard comments about the Dems blackmailing Trump to keep Sessions as AG but I don’t think he’s (Trump, that is) very worried about anything they might throw at him. Especially if he has a pocket full of indictments to play with.
No, while Sessions hasn’t shown me much to brag about, I’d have to believe he’s shown his boss plenty. Besides, he doesn’t have to show us anything. I’m impressed enough with Trump to let him handle this for me...
I am hoping for 4th of July pardons that include the Hammonds.
Our congressman Greg Walden says Trump called him to discuss it and is giving it serious consideration.
Everyone can guess what the 9th circus will do to this. It may end up at the USSC. It is sad to think that someones life can be so stressed by Federal prosecutors.
