The underpinnings of this investigation create far more questions than they answer.....

The government (to include Mueller) have an ethical and legal obligation to provide Flynn and his defense any evidence or information that is exculpatory in nature. This would include the rumors of altered 302’s, contradictory statements about wether the agents believed he lied, and even the basis of the information they used to show he lied (if he was illegally unmasked). On top of that, it appears that Flynn was set up based on an unmasked conversation he had with the Russian ambassador. We know reliably that he had just met with the agents the day before regarding background checks for incoming staff and he believed the second meeting was for the same purpose - i.e. - he was trying to be helpful NOT knowing they were investigating him for a statute that HAS NEVER been charged before - a Logan Act violation.

We know Flynn was unmasked because the compartmented TOP SECRET transcript was leaked by somebody to the media!

If Flynn were to appeal the conviction on the underlying charge he would win it easily. The statute says a citizen of the U.S. - the incoming security head of an administration in transition is not a mere citizen. He is the representative and assumes the authority of the President Elect. This was the crime he allegedly lied about.

Compare the two....

Flynn - the incoming security chief for the Trump administration in the transition talking to the Russian Ambassador

John Kerry - the ex-Sec of State who has no authority at all meeting in secret with the Iranian Government telling them to go to the Europeans to fight Trump

On the common sense scale...... which of these two events violates the Logan Act?

You are misinformed.
Go read the guilty plea.
That’s what Flynn or being sentenced for. There is no mention of Logan Act.

He lied to the FBI about his meetings with the Russians, and failed to register as a foreign lobbyist.

The Logan Act stuff was thrown around by Insane Sally Yates, but never charged. I doubt the FBI even brought it up in the plea negotiations.

Flynn’s biggest problem is he pled guilty. It’s hard to claim innocence after doing so.
