Maybe the judge just wanted to defy what the president wanted. Most judges have a very high ego, and do not like their authority bogarded, questioned or overridden.
I don’t know if anything more can be done about it.
Maybe the families of those men killed can sue Bergdahl for culpability of some kind.

Someone on fox- a military person- stated that there is a general or something that oversees all court marshal trials and has the final say in the matter- so there is a ‘slim hope’ that this fella- who denied obama’s request that the man not be tried in military court twice- might over-ride the judgement-

But, if true, it is a very slim hope I’m guessing

I say civil suits to get at his 300k in back pay for the stupid promotion to Sgt.

I agree that the Judge was bristling over his authority being thwarted past comments, but lets look at that.

He was not the Judge at the time when Trump made his pre-election remarks.

It is a well understood basis for successful appeal to have Command Authority interference in conviction or sentencing. But does that apply when it is comments made before the person is elected to the position of authority.

The stupid Hawaiian judge that stopped the immigration orders from the new President cited campaign statements to base his position upon in that ruling as well.

I, and most posters, understand all the reasons that he should be in Leavenworth- — we don’t need a rehash of those. This Judge letting the convicted deserter slide can make the case that a successful appeal could have even overturned the conviction if he had not given such a nothing sentence that the perp will feel lucky and move on. How about a good legal scholar addressing the area of comments made before the person is in the position of legal authority?

Of course something can be done. President Trump is CinC. He can’t and shouldn’t directly interfere with the sentence, but now that the case is over, BB is still in the military and still subject to military orders.

Remember what the President said while he was still a candidate? About sending him back alone? What’s to stop him from giving that order now?

Scarier still is the very real prospect a military judge is compromised politically.

Leftist military judges? Frightening.
