A federal judge declared unconstitutional the recall of Senator Frank Church.
Recall of US Senators needs to be amended to the Constitution via Article V by a proposal of 34 state legislatures and ratified by 38. The Convention of States has lined up a solid list of state legislatures that is growing toward this goal.
Some political heavyweights have weighed in recently that a recall provision in the US Constitution would have stopped Obamacare outright.
Here’s what an amendment with recall provision looks like:

AMENDMENT XXVIII (’Federal State Rebalancing’)
To restore the foundational structure of State Legislatures to Congress, the following amendment is proposed:

Section 1.
Senators in Congress shall be subject to recall by their respective state legislature or by voter referendum in their respective state.
Section 2.
Term limits for Senators in Congress shall be set by vote in their respective state legislatures but in no case shall be set less than twelve years nor more than eighteen years.
Section 3:
The seventeenth article of amendment to the Constitution of the United States is hereby repealed.

Section 1 and 2 are great. Section 3 is a “Hell, No !” Corrupt and gerrymandered state legislators choosing Senators for the people is 100% unacceptable. That very corruption is why the 17th was ratified with the overwhelming support of the American public.
