Not calling such an agreement a treaty does not actually diminish the fact that it is a treaty. Much like the Paris “Agreement” was a treaty for the federal government, despite Obama’s lying about it.
NO, they can't. Here's what Article I, Section 10 of the U. S.Constitution provides:
No State shall enter into any Treaty, Alliance, or Confederation[.]
* * *
No State shall, without the Consent of Congress, . . . enter into any Agreement or Compact with another State, or with a Foreign Power[.]
State rights are about the laws pertaining to citizenship in the state. Federal rights are about the relationship of one state to another and the combined states to other nations. Under the Constitution a state cannot establish a treaty with a nation. To do so places that state outside the perameters of statehood.
We fought a war to preserve the union. I have no doubt we will do so again. Lincoln faced precisely the same sedition that is brewing against Trump. Trump is every bit as effective as Lincoln. He will be dragged into this war and he will win it.
