Gorsuch doesn’t really change the balance of the court. The Democrats would rather use the filibuster to block a replacement for one of the Marxist mutants on the court. If they use the filibuster now and the GOP uses the “nuclear option” to bypass them, they’ve used all their ammunition on a judicial appointment that won’t have a major impact on the court anyway.

Apparently there are a handful of democrats that are smart enough to realize that once the filibuster is gone, they will have absolutely nothing left in their arsenal if Ruth Bader Ginsburg or another liberal justice assumes room temperature. At which point, the Republicans could ram through Atilla-the-Hun with 50 votes if they wanted too....

With McCain, Graham, Murkowski, and Susan Collins on the GOP team, 50 votes might be a stretch, depending on the nominee. On the other hand, things might look different after the 2018 elections.

The GOP couldn’t ram through anything even if it required only one vote and they held all 100 seats.

I think that either they have been told, or maybe it dawned on their thick skulls, that this is a replacement for a conservative seat (Scalia), so no net loss or gain. It is a lot like the lack of pushback from Republicans on the 2 commie girls, Sotomayor and Kagan — they were replacements for 2 hard lefties anyway (plus the R’s were squishy about opposing brocko, or women [but I repeat myself]), so no net effect there, either.
So, let’s say the lefties filibuster Gorsuch. The chess move would then be to cancel the filibuster rule, and leave it that way for the two or three forthcoming SCOTUS picks. They know that would be ballgame.
So, they have to pretend to posture like badass tigers on this one (for the left-field bleacher base, ya know), but in the end, they DON’T WANT the Repubs to go nuclear on this and all future seats.
It’s a no-brainer.

I'm no fan of McConnell, but credit where credit is due, he did a pretty good job with Trump's cabinet, getting 13/14 confirmed and the one that didn't get confirmed, Trump's labor secretary, could have been confirmed but dropped out for personal reasons.

Attila wimped out when Pope Leo told him not to attack Rome. We don't need another nervous Nellie on the Court. We already have John Roberts.

Clarence Thomas was approved 52-48 if I remember correctly...at any rate had less than 60 "Yes" votes and was confirmed. So Gorsuch could be confirmed with less than 60 votes.

If the Rats are smart they will let him through and save their theatrics for the first case where a conservative justice is nominated to replace a retiring left-wing justice...but their base may demand a filibuster now.

Totally agree. That’s why I think that, in the end, Gorsuch will get the 60 votes for cloture, although he’ll probably only get 54 or so for confirmation.

Bill Nelson’s up for re-election next time. So he’ll be allowed to vote however he thinks helps his re-election chances. Again, it will all be based on polling data.
