Let us concede that short-lived National Security adviser and former head of the Defense Intelligence Agency Gen. Michael Flynn did a dumb thing when he misled Vice-President Pence on whether he discussed sanctions on Russia in a conversation with Russian ambassador Sergey Kislyak fefore President Trump was sworn in January 20.
Flynn may even had said some dumb things in a conversation he should have known was being recorded. But an incoming National Security adviser talking with a Russian counterpart a violation of the Logan Act which forbids private citizens from conducting what is essentially foreign policy with foreign governments. Flynn was clearly not a private citizen at the time. He was a member of an administration whose President, Donald Trump, has historically demanded loyalty and truthfulness from his subordinates. He hung Vice President Pence out to dry and gave the administrations enemies ammunition and a scalp they had been looking for. For that his resignation was well-deserved..
Certainly Flynn had enemies among the CIA holdovers in the CIA, the State Department, and even the Justice Department. Currently the CIA looks like the culprit in the leak of a transcript of Flynns conversation. But here is the real crime that should be investigated. Intel agencies can monitor the phone calls of foreign governments, foreign officials, and foreign individuals. But they cannot monitor the phone conversations of Americans without probable cause and a court order. Whoever leaked the contents of Flynns conversation is the criminal, not Flynn.
President Trump has long been skeptical of the conclusions of former Director of National Intelligence James Clapper and the intelligence community and rightly so. The CIA and the intelligence community dont like Trump or Flynn very much. This the same James Clapper that once lied to Congress, saying that the NSA wasnt conducting surveillance of the American people.
As U.S. News and World Report noted, his recent resignation didnt assuage critics who believe James Clapper, like other Obama administration personnel, dodged a perjury bullet when he testified before Congress on the issue of NSA surveillance of American citizens:

Clapper later told MSNBC he considered the question akin to asking, When did you stop beating your wife? and so gave the least untruthful answer.
