Since the 9th Circuit denied the Appeal, if the DOJ rushes too fast to the SCOTUS, might the current ruling become the rule with the current SCOTUS at 4 to 4?
Should Trump wait until Gorsuch is seated to get this in front of SCOTUS?
The 9th circuit has scheduled the appeal not denied it. They will hear the appeal and overturn a blatantly unconstitutional ruling. Even the 9th isn’t that far off the rez.
