To: Pearls Before Swine

I’ve heard this bandied about.

Some people are making the claim that the sensitive nature of the documents will make it impossible for a GJ or a criminal jury to be seated, as even members of Congress on the Intelligence committees are not cleared to see so much as the redacted portions of some of the emails.

Hope someone here can put my mind to rest on that one.

If that were the case, no such cases could be ever be prosecuted. There are procedures to conduct prosecutions where classified material is involved.

The FBI’s first priority mission is counter-intelligence, ahead of law enforcement. They are specialists in prosecuting cases involving highly classified material.
