so let me get this straight, the cops doing the shooting had ALREADY lawyerd' up, but all the suspects that didn't have a lawyer and wouldn't talk to the police would be charged???
I also explained to Detective Chavez as well as other investigators, that I had asked representatives from the DAs Office, if someone could be charged under this affidavit if they refused to speak to a detective during an interview

IOW, if you voted for a candidate for office in the Texas Confederation of Clubs and Independents or said Billy Bubba was a good guy and they happened to be a Bandido or Cossack, then you were automatically arrested and charged with engaging in organized crime. The mere fact of being on a motorcycle anywhere in the city of Waco that day caused a few to get arrested.

The trigger for charging was intended to be something resembling affiliation with Cossacks, Bandidos, or support for either club. The question posed by Price was whether or not the DA would support arrests based on evidence other than testimony by the detained.
In other words, refusal to cooperate wasn't enough, on its own. But refusal to cooperate coupled with a finding a "I support the fat Mexican" card in the wallet, patch on a vest, etc., that would be enough.
Elsewhere in the report, the writer says this ...

Later, the writer clarifies the conditions for arrest and accusation ...
... someone could be charged under this affidavit if they refused to speak to a detective during an interview; as long as the detective was able to see or document they were either a Bandido or a Cossack, or a supporter of either one.
