The fact that so many apparently innocent people now find their fates in the hands of this grand jury raises a familiar question: Why were they arrested in the first place?

What appears to be definitive answer can be found in a report written by Waco Police Sergeant J.R. Price on July 1.

The report both alleges that multiple Waco police officers fired their weapons during the Massacre and that District Attorney Abel Reyna arbitrarily decided to charge anyone who uttered a word of support for either the Bandidos Motorcycle Club or the Cossacks Motorcycle Club. .)

so let me get this straight, the cops doing the shooting had ALREADY lawyerd' up, but all the suspects that didn't have a lawyer and wouldn't talk to the police would be charged???

I also explained to Detective Chavez as well as other investigators, that I had asked representatives from the DA’s Office, if someone could be charged under this affidavit if they refused to speak to a detective during an interview

5 months later and more of what we expected was going on. That must have been some crazy scene at the Convention center. Sounds like cell phones went in one big heap.

I was aware of an ongoing investigation and intelligence that had been coming into their agency, that DPS had been sharing with other local Police Agencies, since at least February or March of 2015.

Sure, keep telling me it was started over some misunderstanding over a parking place.

It should also be noted there were detectives from Waco PO, Department of Public Safety agents, McLennan County Sheriffs Office staff, that were present in the lobby during the conversation

West PD and others were involved. Guess ATF was given a get out of jail free card.

It was explained to me that if a person was wearing a patch, clothing or insignia that indicated he or she was a supporter of the Bandidos or Cossacks; or if they mentioned in an interview that they were a supporter of the Bandidos or Cossacks, then they should also be charged with engaging in organized crime.

IOW, if you voted for a candidate for office in the Texas Confederation of Clubs and Independents or said Billy Bubba was a good guy and they happened to be a Bandido or Cossack, then you were automatically arrested and charged with engaging in organized crime. The mere fact of being on a motorcycle anywhere in the city of Waco that day caused a few to get arrested.

Like nail clippers, wallet chains and screw drivers out of tool boxes. How many of those cell phones' video was deleted?

I think it was Clendennan, but not sure someone who got their phone back said it was wiped clean. All of them were probably.

And, guess what Waco PD, there are cell phone forensics qualified expert witnesses who will be able to determine if deletions occurred DURING THE PERIOD WHEN THE WACO POLICE DEPARTMENT HAD THOSE SMARTPHONES IN THEIR POSSESSION.

The entangling web is growing around the Waco authorities.

He alleges violation of 42 U.S.C. §§ 241, 242 involving Conspiracy Against Rights and Deprivation of Rights Under color of Law, and further, violation of Clendennen’s First, Fourth, and Fifth Amendment rights. Those elements of the Bill of Rights allow freedom of association, the protection against unreasonable search and seizure without specific allegations of complaint, and the right against self incrimination. .

The trigger for charging was intended to be something resembling affiliation with Cossacks, Bandidos, or support for either club. The question posed by Price was whether or not the DA would support arrests based on evidence other than testimony by the detained.

In other words, refusal to cooperate wasn't enough, on its own. But refusal to cooperate coupled with a finding a "I support the fat Mexican" card in the wallet, patch on a vest, etc., that would be enough.

Elsewhere in the report, the writer says this ...

... I learned a decision had been made that upon interviews with any of the individuals, if it was learned that they were members of the Bandidos or Cossacks; that they would be charged with engaging in organized crime ...

Later, the writer clarifies the conditions for arrest and accusation ...

... someone could be charged under this affidavit if they refused to speak to a detective during an interview; as long as the detective was able to see or document they were either a Bandido or a Cossack, or a supporter of either one.

The Price report posted at Aging Rebel doesn't include any objection; it simply asserts that the instructions and criteria for accusation and arrest came from the DA's office.
