When someone says they can’t breathe that usually indicates that they’re having difficulty breathing.

In a casual setting, sure. In an attempt to get out of the situation of being arrested? It’s potentially and reasonably an attempt to gain advantage.

Further, difficulty breathing is not the same as inability to breathe...at all.
