Obama's Executive Actions (vanity)

There is no such thing as the "Dream Act". There have bills so named but none of them has become law.

Undeterred, Obama implemented in 2012 via the "Deferred Action for Childhood Arrivals" program (DACA) many features of the failed bills.

Guidelines  You may request DACA if you:   

  1. Were under the age of 31 as of June 15, 2012;
  2. Came to the United States before reaching your 16th birthday;
  3. Have continuously resided in the United States since June 15, 2007, up to the present time;  
  4. Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS;
  5. Had no lawful status on June 15, 2012;
  6. Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and
  7. Have not been convicted of a felony, significant misdemeanor,or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

Here are some provisions of one of the failed "Dream Acts", S. 3992 (DREAM Act of 2010)

Authorizes the Secretary of Homeland Security (DHS) to cancel the removal of, and adjust to conditional nonimmigrant status, an alien who:
(1) entered the United States before his or her 16th birthday and has been present in the United States for at least five years immediately preceding this Act's enactment;

(2) is a person of good moral character;

(3) is not inadmissible or deportable under specified grounds of the Immigration and Nationality Act;

(4) has not participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion;

(5) has not been convicted of certain offenses under federal or state law;

(6) has been admitted to an institution of higher education (IHE) or has earned a high school diploma or general education development certificate in the United States;

(7) has never been under a final order of exclusion, deportation, or removal unless the alien has remained in the United States under color of law after such order's issuance, or received the order before attaining the age of 16; and

(8) was under age 30 on the date of this Act's enactment.

Authorizes the Secretary to waive specified grounds of inadmissibility or deportability for humanitarian, family unity, or public interest purposes.
Entered prior to 16 years old, have been here 5 years, in school, etc. Sound familiar?


On Nov 20, 2014 Obama issued a document titled "FACT SHEET: Immigration Accountability Executive Action" in which it is announced:

Expanding DACA to cover additional DREAMers. Under the initial DACA program, young people who had been in the U.S. for at least five years, came as children, and met specific education and public safety criteria were eligible for temporary relief from deportation so long as they were born after 1981 and entered the country before June 15, 2007. DHS is expanding DACA so that individuals who were brought to this country as children can apply if they entered before January 1, 2010, regardless of how old they are today. Going forward, DACA relief will also be granted for three years.
Both the original DACA program as well as the Nov 20, 2014 memo violate the law, for example: 8 USC § 1182(a)(6)(A)(i)

Obama has given to Executive departments orders which violate law. The U.S. Constitution’s structure is for Congress to legislate and the executive branch to implement legislation. Obama's actions have the effect of legislating in place of Congress.

The point is, Obama has given to Executive departments orders which violate law.

Obama usurps, Congress bleats.

N.B. This is the same Congress which will, upon petition by the States, call an Article V Convention for the purpose of proposing Amendments to the Constitution and which will decide the method of Ratification.

Most non-freepers can only stutter when posed with this question: What was the salient purpose of the Constitution?
DUmpers will say, ‘to establish a central government’.

We know that it formalized the short, ‘kiss-off’ letter to King George III.
And you would think that a former part-time instructor of constitutional law would know that, regardless of what he and the Democrats, the Federalists and the GOP establishment would have us believe:
the U.S. Constitution was written to preserve the liberty of the People and the free republic adopted by the people through their representatives.

FWIW: The California Bill that provides in-state tuition for illegals is called The Dream Act.

I did a brief search on what Executive Actions are (what his latest amnesty speech was about) and what Executive Orders are.

As far as I can tell, Executive Orders tell how to carry out a law, and are often for such things as creating an office for trade development with the Congo, revising a list of reasons for quarantine, etc. Although obama has also made some EO with regard to minimum wage for contractors, one for “fair pay”, and others.

Executive Actions are a wish list, that it sounds like may or may not be followed up with. Many (all?) of the changes that he has made to obamacare were EAs. He did 21 EAs regarding guns after he was re-elected.

This amnesty thing is an EA. Although it sounds like everyone, including the GOPe, views them as the law of the land now.

FACT SHEET:  Immigration Accountability Executive Action

The President’s Immigration Accountability Executive Actions will help secure the border, hold nearly 5 million undocumented immigrants accountable, and ensure that everyone plays by the same rules.  Acting within his legal authority, the President is taking an important step to fix our broken immigration system.

These executive actions crack down on illegal immigration at the border, prioritize deporting felons not families, and require certain undocumented immigrants to pass a criminal background check and pay their fair share of taxes as they register to temporarily stay in the U.S. without fear of deportation.

These are common sense steps, but only Congress can finish the job. As the President acts, he’ll continue to work with Congress on a comprehensive, bipartisan bill—like the one passed by the Senate more than a year ago—that can replace these actions and fix the whole system.

Three critical elements of the President’s executive actions are:

The President’s actions will also streamline legal immigration to boost our economy and will promote naturalization for those who qualify.

For more than a half century, every president—Democratic or Republican—has used his legal authority to act on immigration.  President Obama is now taking another commonsense step. As the Administration implements these executive actions, Congress should finish the job by passing a bill like the bipartisan Senate bill that: continues to strengthen border security by adding 20,000 more Border Patrol agents; cracks down on companies who hire undocumented workers; creates an earned path to citizenship for undocumented immigrants who pay a fine and taxes, pass a background check, learn English and go to  the back of the line; and boosts our economy and keeps families together by cutting red tape to simplify our legal immigration process.

CRACKING DOWN ON ILLEGAL IMMIGRATION AT THE BORDER

Under the Obama Administration, the resources that the Department of Homeland Security (DHS) dedicates to security at the Southwest border are at an all-time high.  Today, there are 3,000 additional Border Patrol agents along the Southwest Border and our border fencing, unmanned aircraft surveillance systems, and ground surveillance systems have more than doubled since 2008. Taken as a whole, the additional boots on the ground, technology, and resources provided in the last six years represent the most serious and sustained effort to secure our border in our Nation’s history, cutting illegal border crossings  by more than half.

And this effort is producing results. From 1990 to 2007, the population of undocumented individuals in the United States grew from 3.5 million to 11 million people.  Since then, the size of the undocumented population has stopped growing for the first time in decades. Border apprehensions—a key indicator of border security— are at their lowest level since the 1970s.  This past summer, the President and the entire Administration responded to the influx of unaccompanied children with an aggressive, coordinated Federal response focused on heightened deterrence, enhanced enforcement, stronger foreign cooperation, and greater capacity for Federal agencies to ensure that our border remains secure.  As a result, the number of unaccompanied children attempting to cross the Southwest border has declined precipitously, and the Administration continues to focus its resources to prevent a similar situation from developing in the future.

To build on these efforts and to ensure that our limited enforcement resources are used effectively, the President has announced the following actions: 

DEPORTING FELONS, NOT FAMILIES

By setting priorities and focusing its enforcement resources, the Obama Administration has already increased the removal of criminals by more than 80%.  These actions build on that strong record by:

ACCOUNTABILITY – CRIMINAL BACKGROUND CHECKS AND TAXES

Every Democratic and Republican president since Dwight Eisenhower has taken executive action on immigration.  Consistent with this long history, DHS will expand the existing Deferred Action for Childhood Arrivals (DACA) program to include more immigrants who came to the U.S. as children.  DHS will also create a new deferred action program for people who are parents of U.S. Citizens or Lawful Permanent Residents (LPRs) and have lived in the United States for five years or longer if they register, pass a background check and pay taxes.

The President is taking the following actions to hold accountable certain undocumented immigrants:

Directives are being given to Executive departments. For example, "DHS will launch a comprehensive citizenship awareness media campaign..."

Also...

Obama Speech:

The failed 2013 "Dreamer" bill Senate Bill 744 contained similar provisions:
SEC. 2106 - funds community organizations to help enroll illegal aliens

SEC. 2538 - funds state and local governments or “other qualifying entities” to establish “New Immigrant Councils”. New Immigrant Councils fund a laundry list of governmental agencies, organizations, schools, etc to provide “workforce training programs”, and to develop programs to “build meaningful connections between newer immigrants and long-time residents”, and other things.

SEC. 2521 - Task Force on New Americans, “The Task Force shall work with executive branch agencies to provide... (A) access to youth and adult education programming; (B) workforce training; (C) health care policy; (D) access to naturalization; and (E) community development challenges”

The lack of a bill to sign into law is no deterrent. Programs will be instituted and funds will be spent without Congressional authorization or appropriation.
