Most tech companies make you sign those when you join up in the engineering area. So I do not agree that his argument holds for forced signing.

The point is that setting out the agreement up front as part of the hiring process is legal since the applicant for the job can accept or reject the employment based on that issue. If he accepts the job, the consideration for the agreement is part of the overal employment agreement. Forcing (ordering)someone to sign an agreement after beubg hired lacks consideration.

Good point. And they could not just walk away like Bergdahl, unless of course they wanted to be dancing boys.
