If the government wanted something they should have first negotiated, then gone to court. Well, to be technical about it, they DID go to court. More than once. Won every time. This was their effort to enforce the court order. What I'm wondering is whether (a) next time it'll be the US Marshals enforcing the order, and (b) whether they might not consider a less confrontational, but more effective, way of inducing compliance. Like for example getting a monetary judgment for the $1M in fines - which is not dischargeable in bankruptcy - and simply levying on his bank accounts. That can be done entirely electronically, with no flash point of direct physical confrontation. Or they could obtain a charging order on the proceeds of any sale of his cattle, and take that order to every one of the beef processors in the tri-state area. The processors would then be legally obligated to remit payment to the Feds, and not to Bundy. I don't understand why they haven't gone that route already, to be honest.

Actually, I didn’t know that as I haven’t followed this. But I suspect they used the confrontational forces because they have them. But, as you point out, the less confrontational approach should work better. So, what is the long term prognosis? (And, actually, I’m against any government ownership of land. Clinton added hugely to the total making millions more acres forever undevelopable.)

BTW, that guy set up on the bridge to cover what was going on below.

There were LOTS more that were out of site.

That's what I'm wondering. The guy on the bridge was a very visible reminder that they were down in a kill-box. But did they get a hint that there were other people set up on ridgelines 500 to 1000 yds out? Guys that were in cover and well beyond the effective range of the pretty little M4s they were carrying?

Right wrong or otherwise from a legal and moral standpoint the BLM on-scene commander made the right call to get his people out of there in one piece.

I was on the way up..either it was going to be yesterday late afternoon or today, as a fellow had called and told me they really needed help. I live about 2 and 1/2 hours from there.

Then i heard the reports of the agreement and quit “packing” my things...

So, this morn, the fellow called and told me the whole story. those government snipers that were on the hills around there? They were covered by our boys up the mountain sides. They make hits from a long way off-and that aint no lie either.
I was seriously trying to stay away for personal reasons.

When did they print up that nice “First Amendment Area” sign? Whose idea was that? Was this a planned confrontation for media purposes?

If the Gov of the state had any balls he would have called up the Nat Guard to support Bundy. THAT would have been interesting.

Would have royally pissed me off having spectators over my shoulder while I am at work, next time move them back, at the very least they are an irritant if not an out an out liability, and should the lead start flying a bunch of casualties slowing the works down.

Sometimes good intentions need to be curbed when business is at hand. That guy should have had a spotter and still yet another to oversee everything else unexpected.

I believe things changed not long ago such that the president now controls the national guard. I don’t know what the governor’s powers are regarding the guard now. Perhaps somebody can comment on this?

I’d suspect, though, that unless the governor wanted to open a can of worms he’d beg off. The feds can strike back in nearly unlimited ways that would put more pressure on the governor than most could handle politically. For example, suppose they stopped all federal highway funds and Medicare/Medicaid payments? I’m sure there are other things I haven’t thought of. Very shortly people would be howling for the governor’s head.
