Its a crime against everyone. The US is a police state now where even the slightest thing can end up with a person handcuffed and beat down.

Even if he had identified himself, he had no probable cause to molest or harass the citizen in any way. Drinking from an ice tea can, without other facts, does not create PC to believe that there is alcohol in the can. The officer could perhaps walk up to him and ask, but the citizen is entitled to tell the officer to take a hike. In America, circa 2008, anyway. Oh, how I miss that country!
