IIRC, if a court has reason to believe that a crime has been committed, they are obligated to make a referral in certain circumstances. Perhaps there is something in Zullo’s sealed affidavit which caused them to go to a US Attorney who could them empanel a grand jury (IANAL and it is late!)
Yes we and the good judge don’t want any premature adjudication for the OBots while their is an active case, especially when the evidence is still flowing in...known as the Ripeness Doctrine. So the case is on simmer.
