I thought the US Flag Code specified that the Stars and Stripes should not be used as part of an athletic uniform?

Yes, nor for advertising purposes. How many times do we see politicians using the colors of the flag and such for campaigns etc.

Yep. Section 8(j) of the U.S. Flag Code:

"No part of the flag should ever be used as a costume or athletic uniform."

You're assuming that most Americans even know what the U.S. Flag Code is. I can't tell you how many flags I see that are mistreated.
