Sort of. In this instance, the judge said he lacked jurisdiction - that ALL judges lack jurisdiction to decide the issue. That the issue is to be decided by Congress, and that the issue is a political question, not a matter of law.

And, I can see Congress doing similar, pointing to a Court and saying it's the court's job, or that a court already decided this (Wong Kim Ark), therefore it is settled.

None of 'em have the decency or fortitude to address the issue head on.
