Another federal circuit court hacks away at recess appointments (Craig Becker appointment)

The U.S. Third Circuit Court of Appeals struck a huge blow against a much-abused presidential power yesterday in invalidating Craig Becker's 2010 appointment to the National Labor Relations Board.

I think it's great news -- the recess appointment is an outdated accommodation for the executive branch, and no president from any party should have such power...But bear in mind that although this decision does resemble a recent one by the D.C. Circuit, it isn't about Obama's flagrantly illegal appointments to the NLRB from last January. This calls nearly all recess appointments into question, and it gives the Supreme Court a historic opportunity to rein in all future presidents and restore congressional authority.

Well then why are all these recess appointees still sitting on the board? The Congress is hopefully defunding their positions.

That’s fair and I can live with ALL recess appointments being banned regardless of who the occupant of the oval office is.

As long as the law is clear and we don’t have to have the media circus for days on end discussing, is this legal or not.
