Harping on pubs and Roberts are not mutually exclusive. Nevertheless, harping on the Republican Congressional Caucus can actually accomplish something, since they face re-election and need votes and campaign cash. Roberts does not. He’s appointed for life and you can protest until you’re blue in the face and it won’t affect him one bit. Having said that, I, too am really angry about that decision. Having listened to him describe his judicial philosophy during his confirmation hearings, I believed he was a textbook strict constructionist who would never pull a stunt like this decision, where he wanders all over the map, twists logic beyond comprehension and issues a self-contradictory monstrosity of a judicial opinion. I doubt we’ll ever know what happened behind closed doors, why this apparent conservative judge betrayed a nation that looked to him to do the right thing.
