A question for all of you who think of these things in detail...when the robbers started to flee, how long can the old guy continue to shoot at them?
Does it matter that the gun for the perp is no longer visible?
They clearly ran out the door to leave...what issues to you see in deciding that this old war horse should not be prosecuted?
My vote: You fire until the threat is eliminated, and that is not dependent upon whether they are running away, if they can still shoot behind themselves.

Those are tricky questions to answer, and unfortunately will depend heavily on what kind of man the local district attorney is, and the state you live in. Fortunately for this fellow, it's in a somewhat rural part of Florida, meaning he can shoot the hell out of them as he sees fit. Even if the DA files charges, no jury would convict him.
