How about looking at it as he's pursuing that which falls within his area of expertise.
The last time I looked he wasn't a Constitutional scholar or lawyer.

I presume that I do not have to point out to you that "Consitutuional scholars and lawyers" are responsible for the mess in which we find ourselves today.
...I think I'd prefer to put my trust in people who are not either of the aforementioned for a while.

In the vid @45 secs, Arpaio said the Hawaiian posse attempted to interview the Obama’s purported BC Registrar from 1961. He didn’t cooperate. Who knows he may later. They keep plugging away, something will eventually break.
They are shaking the Obama tree to see what falls out.

Arpaio is pursuing document fraud. Like stated, he isn’t a constitutional lawyer, so the citizenship of Obama’s father doesn’t concern him from a professional standpoint.
