There is no loophole, the returns described are blatantly fraudulent. You can only claim Qualifying Children and to be one the child must live with you for more than 6 months AND be either a US Citizen, US National, or US resident. Kids back in Mexico DO NOT QUALIFY. But then again, why would an ILLEGAL worry about following tax law if they don’t follow immigration law. See Pub 17, pg 231.

I heard about this scam a year ago.
A Hispanic acquaintance of mine was chatting with a neighbor at the store, an Illegal Immigrant. The illegal lady described how she went to a storefront tax prep office where they COACHED HER ON HOW TO APPLY FOR A REFUND.
The illegal lady bragged, “I got a check for over $9000 and I didn’t even work last year!”
The IRS needs to send a few undercover agents into storefront tax prep offices and put the perps behind bars for an extended stay...with total asset seizure. Then they need the guy’s client list to prosecute as well.
