State judge assigned to Bibb-Monroe County border dispute

A state judge was assigned Monday to scrutinize a long-standing Bibb-Monroe county border dispute. Deputy Chief Judge Michael Malihi will hear the case late this month in the Office of State Administrative Hearings. However, his intervention won’t settle the case. Malihi will review the facts and make a recommendation, which would be sent back to Secretary of State Karen Handel. The judge will review the plat, a land survey, Bibb County’s protest to the survey and Monroe County’s response to the protest.

State will review complaint against Clayton school board

Gov. Sonny Perdue said Thursday a citizens’ complaint asking him to remove the Clayton County school board has merit and has forwarded the case to a state agency for further review.

Five Clayton County residents filed the complaint with Perdue on June 23, saying the board lacks leadership and is floundering “like a rudderless ship.”

Perdue referred the matter Thursday to the Office of State Administrative Hearings.

“I have reviewed the complaint, and I believe that it raises sufficient, specific allegations that warrant review,” Perdue said in a release.

Administrative Judge Michael Malihi will hear the case at 8 a.m. on July 17, two days after an election for seven board seats.

MARINA DECISION REVERSED - COURT NARROWS INTERPRETATION OF COASTAL MARSHLANDS PROTECTION ACT

A much-lauded Georgia law that protects the salt marsh can’t be applied as widely as environmentalists would like, the Georgia Court of Appeals ruled Wednesday.

The decision is a win for mega-developers, who have long contended the Coastal Marshlands Protection Act applies only to those portions of a project that touch the marsh.

“We are grateful the Court of Appeals has corrected the Administrative Law Judge’s mistakes concerning the permitting of these important amenities for our homeowners,” Atlanta-based Land Resource Company CEO Mike Flaskey said in a written statement.

Land Resource is building Cumberland Harbour, a 1,068-home luxury community in St. Marys. Its application for the state’s largest marina complex - two full-service marinas and three community docks that could accommodate up to 700 boats - sparked a series of legal challenges.

In March 2006, Administrative Law Judge Michael M. Malihi instructed the Coastal Marshlands Protection Committee to consider the impact on the marsh of not only the proposed marina complex, but also the houses and roads in the development.
