Blue, the trick is to get this to the SCOTUS. It really doesn't matter at this point who joins whom. The issue of "Natural Born Citizenship," must be addressed by none other than the SCOTUS.

Frankly, from our POV, this has risks. Namely, the present SCOTUS, with Goofy Ginsburg, Kommie Kagan, and the other Far Left Lesbo, none of whom can be expected to recuse themselves, need only attract two more weak sisters. (Souter? Kennedy?) Also, what if The Mombasa MF has the chance to appoint another?

But win, lose, or draw, settled this issue must be.
