It doesn’t. But the states have laws against it.

The cops dealing with the OWSers are STATE police officers and may enforce STATE drug laws. There is no Constitutional provision forbidding STATES from making and enforcing drug laws.

National Guard mobilized to assist state police are mobilized by the Governor of the State in question and are state officers as such.
