I read somewhere that all Boeing had to do is run out the clock. The two members of the NLRB that Obama recess appointed Becker and Pearce, are forced out on December 31, 2011, when the recess appointment expires. The senate is not going to confirm either one to a full term (democrats couldn’t even get them confirmed when they controlled 60 seats). This will leave the NLRB with only two members, the Supreme Court ruled in 2009 that NLRB can not render decisions or issue rulings with only two members. So they are effectively dead come January 1st.
