Tom Petty won't back Michele Bachmann's use of 'American Girl'

Among the many traditions for presidential candidates on the campaign trail are kissing babies and getting kiss-offs from rock musicians over unwanted use of their songs. A day into her campaign for the White House, Michele Bachmann is already facing the latter custom.

Tom Petty has sent the Minnesota congresswoman a cease-and-desist order after she used his 1977 classic "American Girl" as background music at her kickoff rally Monday in Waterloo, Iowa, a source close to the singer has confirmed.

This is not the first time Petty has sent out such an order: George W. Bush's team also received one in 2000 when the future president used "I Won't Back Down" at campaign stops. Nor is it the first time a candidate has used "American Girl:" Hillary Clinton also spun it at many of her presidential campaign rallies in 2008, without any complaint from the Rock and Roll Hall of Famer -- who is otherwise relatively apolitical in his music and public life.

All day yesterday the talking heads were repeating how "petty" Michelle Bauchmann was for not accepting Chris Wallace's apology (which she did when he sincerely offered it TO HER). Guess we really see who is "petty" after all.

Correction: It’s “McGuinn” not McGwinn.

Correction #2: It is a Tom Petty song that McGuinn covered a few month’s after Petty’s release. I’ve heard both versions and they are very, very similar.

Nope ASCAP, BMI, SESAC, etc. are facilitators and nothing more. The Rights are owned by whomever holds the publishing, music and lyric rights. ASCAP just collects the performance and radio/TV fees and issue checks to the rights holders for such.

Do we know for sure she wanted it as her campaign theme song? Heart did the same in 2008 when Barraccuda was played at McCain/Palin rallies.

And playing in a band in Gainesville in the 70’s called “Mudcrutch”.... folks called them mudcrotch. Strip joints and pot festivals in the woods.

Lessee, he imitates the sound of Bob Dylan (yuck) and/or Roger McGuinn and his 12 string— equally yuck singers. Such were the times of the 70-90’s when record biz could print money... not anymore.

that said “Free Fallin” is not too bad.

Public domain after 25 years? No, the copyright laws were changed several years ago and it’s possible for the copyright holder to retain control virtually forever. There are several areas of rights: songwriter/publisher, public performance and master use(the actual recording itself). This comes up every election cycle and the politicians always quietly cease and desist. There are some who swear it’s legal to use without permission but, so far, the artist has always prevailed.

If he holds publishing and writer rights, he does have the right. Usually this is to collect unpaid royalties for use. If Bachmann asked permission, then they did the right thing. This can't be enforced really, except in public performance media content like youtube, radio, tv etc.

Remember the clintoons love of fleetwood mac “don't stop..” another band of moral reprobates— both clintons and the band.

See: Rush Limbaugh use/royalty payments on use of “My City Was Gone” by Pretenders... ultimately publisher wants the money so it's in the owner's purview.
