Reading through the original document is unbelievable, and would almost be funny if it were not so frighteningly true.
The disclaimer sounds like those wonderful little lightspeed readings following the drug ads, with all of the possible side effects raced through : / Kind of a, “Well, if you take it and end up worse off, it is not our fault, because we told you about it”, situation. And strangely enough, it seems to say upfront that they really have no authority to do this, but they are doing it anyway : o
“”Disclaimer
As there is no right to the favorable exercise of discretion by the agency, nothing in this memorandum should be construed to prohibit the apprehension, detention, or removal of any alien unlawfully in the United States or to limit the legal authority of ICE or any of its personnel to enforce federal immigration law. Similarly, this memorandum, which may be modified, superseded, or rescinded at any time without notice, is not intended to, does not, and may not be relied upon to create any right or benefit, substantive or procedural, enforceable at law by any party in any administrative, civil, or criminal matter.””
May God give us strength to get to 2012, and the ability to choose wisely.

That disclaimer basically allows all agents of the government to ignore the above if it obstructs normal duty.
