I guess the best thing is for you to believe what you believe and for me to continue believing what I believe. As I said earlier, it may have something to do with the difference between courts of special jurisdiction and courts of general jurisdiction. And there is a question of statutory law versus common law.

I know when I investigated it in the late 90’s there were still a FEW states where ANY PERSON could convene a grand jury. But in most states, that has been changed and people can’t do it unless they go through the ropes.

I guess it would depend on the Rules of Criminal Procedure for whatever state you are in.

The use of a private prosecutor was incorporated into the common law of Virginia and is still permitted there.[3] Private prosecutors were also used in North Carolina as late as 1975.[8]

Corsi promoting his books = bad

The only differences of course is that Corsi authors his own books without the need for a ghost writer (unattributed at that) and Corsi’s books are based on facts, whereas Obama’s are based on fiction.

According to your link, Virginia is the only place where a private citizen can prosecute.

It's also not possible at the Federal level.

Well, we’ve gone from “Where’d you get that idea? Yur a doofus” (my paraphrase) to “well, you can still do it in Virginia, but that’s the only place” (my paraphrase again).

Even the the article explicitly says it is still possible in Virginia but NEVER says it’s not doable in other jurisdictions as well.

You file the proper papers with the court.
The court either rejects them or lets the time limit pass.

You go to a higher court and petition for a writ of mandamus compelling the lower court to adjudicate the issue.

Look, I understand why the procedures have been adapted. It is to speed up and make uniform the administration of justice.
And nobody wants all the sudden for there to be ten million criminal charges filed all over the US by people who are angry because their neighbors dog took a dump in their yard.

But the procedure and process and administration of the law cannot be interpreted in such a way that it favors anybody in particular, or that it in any way denies some party Due Process and substantive rights.

As I said, I’m not an attorney and have no desire to be one. But I have tens of thousands of pages worth of info on law, and have read alot of it. I have the entire U. S. Reports series (Supreme Court decisions going back to abt 1778). I have the complete collection of the United States Statutes at Large. I have the Annotated Constitution, which is The United States Constitution, Analysis and Interpretation, authorized by Congress and prepared by the Congressional Research Service, based entirely on the Constitution and the Supreme Court decisions that have interpreted constitutional issues, 2500+ pages of analysis.

And lots more than that.

So.
I stand by my assertion.

In America, anyone can be sued in a civil suit for pretty much any reason.

But in this case, it's unlikely to happen. Why would BHO want Corsi to shut up? Corsi working to get white supremacists on the birther wagon is an early Christmas present for Obama.
