Sec. Clinton: WH Needs "No Congressional Authorization" for Future Decisions on Libya

Whether you support the overthrow of Dictator Maummar Gaddafi or not, the administration's handling of the situation cannot be described other than horrendous. First, according to critics, the President dithered for over a month on what to do in Libya. He waited for the Arab League to act, then the United Nations...

Now, according to the President, the War Powers Act allows the President, at least in the short term, to order the attack, bombing, or infiltration of a foreign country without even notifying Congress, let alone waiting for their approval. That is a nice line and all, but apparently that's all it is: a line.

According to legislators who were in a meeting with Secretary Clinton today, she told them:

[T]he administration acted within the requirements of the War Powers Act and needed no congressional authorization for further decisions on the mission.

Let me emphasize that for a moment: the administration needs no congressional authorization for further decisions on the "kinetic military action" in Libya? What does that mean exactly? Does that mean that, should the President want to expand the attack, he simply can without approval? Does that mean that, according to this Administration's interpretation of the War Power's Act, that the President can declare war unilaterally?

was a United States Congress joint resolution providing that the President can send U.S. armed forces into action abroad only by authorization of Congress or in case of "a national emergency created by attack upon the United States, its territories or possessions, or its armed forces." The War Powers Resolution requires the president to notify Congress within 48 hours of committing armed forces to military action and forbids armed forces from remaining for more than 60 days, with a further 30 day withdrawal period, without an authorization of the use of military force or a declaration of war.
The resolution was passed by two-thirds of Congress, overriding a presidential veto.

Empress Clinton obviously hasn't read Wiki. Congress is the only governmental entity in the USA who has the power to declare war:

Why is she jumping in the middle of this? Seriously. She had taken her prints off Obama’s foreign policy bungles after he backstabbed her on Egypt and I thought the Clintons’ plan was to let the Big 0 twist in the wind and then bail. Now she’s taking ownership of this Libya disaster with this nonsense.

So their actions are doubly illegal.
Where they did notify congress, the United States, its territories or possessions, or its armed forces where not attacked.

They also MUST withdraw by 90 days and they promised they did not have to do that either.

Here’s a theory...

nobama had CIA working with the jihadists - that’s why the “finding” order was signed weeks ago, the order was needed once the operation was ready to start.

State knew nothing of the inside job, which is why Hilly’s initial statements conflicted with WH.

I’ll bet WH is using Bush’s ongoing programs aimed at fostering Democracy. Using all the same orders, documents, etc., they were just ordered by nobama to work with people who were always considered enemies in order to effect the revolutions. The WH cover is that they are pursuing Democracy, while the top is completely aware that they are actually turning over whole nations, armies and oil wealth to America’s enemies.

Just a theory. The challenge, of course, would be to get evidence of what nobama knew and did and when. But even if there is evidence, we’re not at war with the jihadists per se; seems like we need this go be a political / news battle.

And there lies the rub. One can argue, as many have on this forum, that the War Powers Resolution was wrong, unconstitutional, etc. But, constitutionally correct or not, the fine print states the requirement of, essentially, a 60-day continuing resolution of the War Powers Act. Thus Clinton is implying, contradictorily, that even though Obama did the cursory requirement of "notifying" Congress within 48 hours of his decision (I predicted he would - the timely post is somewhere in Freeperville) somehow the secondary requirement ("...and forbids armed forces from remaining for more than 60 days, with a further 30 day withdrawal period, without an authorization of the use of military force or a declaration of war...") doesn't apply.

That, in short, is an admittance to trying to have one's constitutional warcake and then unconstitutionally eating it too.

We need to get Congress to revoke the powers given to Bush after 9/11. Obama renewed them in 2009 and 2010. The Homeland Security provisions were revised in 2007 giving the president more powers in the Annexes of Continuity of Government. They are so secret even Congress can’t see them. Some say it gives the President power to become a Military Dictator in case of another attack/planned crisis. His actions seem to invite attacks.
