Officials of the Department of Homeland Security are denying that it was their policy that caused Border Patrol agents to observe suspected drug runners through night-vision scopes, see that they were armed with rifles, and despite this, shoot at them with a bean-bag gun. But the drug runners, under no such ridiculous orders, returned fire with real bullets, killing one agent − and illustrating that AK-47s beat bean bags every time.

I am not a trained law-enforcement officer. But even I know enough that if I saw suspects armed with rifles, I would take cover, call for backup if possible, and then engage them with rifles. Even I know enough not to fire a handgun at criminals armed with rifles unless absolutely necessary. The thought of firing a bean bag at criminals armed with rifles would never enter my mind.

But the agent was a trained law-enforcement officer, as well as a former Marine. I am sure that the only reason he fired a bean bag was that he feared losing his job if he used “excessive force.” Instead he lost his life, his parents lost a son, his siblings lost a brother, his buddies lost a friend, and we lost a valuable citizen.

The criminals who murdered him should pay with their lives. But the criminals who authored the idiotic policy should pay with their jobs, and if possible with prison time. The death of agents for whom they were responsible was clearly foreseeable. Issuing that order was similar to speeding through a school zone, or firing a gun in the air on New Year’s Eve − there was no explicit intent to kill anyone, but there was, in legalese, a “willful or depraved indifference to human life.”

I have no idea what the actual dynamics were; I would hope he was armed with more than a bean bag device. I’m afraid his “superiors” may not have bean bags for brains at this point..
