My initial reaction, without specific knowledge of the particulars of this case, is that there is some fundamental problem with how the case was pleaded. My impression is enhanced by previous commentaries on FR (including John Armour) who opined that specific cases would go no where. My recollection is that there was some technical problems with the cases.
I find it hard to believe that a conspiracy is so wide spread that all judges are swept up in it. I am also frustrated that it appears only fringe lawyers have taken up this case.
