Even if they take it to court, they would have to plead the 5th amendment, because just by the fact they have to take a state to court for eligibility laws that states have passed shows the world there is something very seriously wrong with Obama.
If they take it to court, then, they and him would have to plead the 5th amendment...

They don’t have to win they just need to tie it up long enough. This guy has shown that he doesn’t give a damn about States rights and so have many of the people around him.

Having said that it would only take one State with enough electoral seats and a good solid conservative judge to throw their whole circus into disarray!
