If Ltc Lakin received improper legal advice, would he not be entitled to enter an appeal of previous military court decisions?

Those prior rulings were that Obama's eligibility isn't relevant to the charges against Lakin, because the orders he disobeyed didn't come from Obama directly. The new lawyer is saying, in nicer words, that Lakin never should have listened to the Birthers who told him to disobey orders so they could get a court test of Obama's eligibility.

What is it that makes you so certain that Ltc
Lakin ‘listened’ to any outside source, and that
he wasn’t proceeding on personal principles ?
