We haven’t operated under the Constitution as laid down by our Founders for some time. The only debate is to when it actually occurred.

As far as I can tell, he is right.

The constitution is enforced only when it aids their ends, otherwise it is ignored or re-written from the bench when necessary.

In fairness to the idiot Stark, having seen the clip, I can’t rule out that he wasn’t just makiing the initial point that the Federal government is CAPABLE of doing most anything (which is hard to argue), and was possibly going to admit that such power doesn’t equate to having unlimited authority. However, any qualification he might have added was quickly shut down by the instant booing.

For all intents and purposes, since the onset of this Regime, there hasn’t been much attention paid to our Constitution.

These cretins look at the constitution in the same manner that Americans look at a roll of Charmin.

I don't think so. I think he's claiming that the Constitution is a dead letter, which unfortunately it is.

The only constitution that has practical effect is that formed by Supreme Court rulings, which can be quite arbitrary and differ substantially from the plain language of the Constitution as amended.

Even mainstream conservative jurists see it this way. Robert Bork famously likened the 9th Amendment to an inkblot. It's been this way for decades -- it didn't start with the Patient Protection and Health Care Affordability Act.

That is the current attitude of this Congress! They will do as they want and they aren't worried about what we think about it. They have no worries about upcoming elections. Why?? Either they are satisfied they have it sufficiently rigged for victory or they will find a reason to not have elections, either in 2010 or 2012.
