Actually it is different. Because Kenya has a parliamentary system, Government Ministers are also members of Parliament. Thus he was speaking as both an MP and member of "the Government". So it's more akin to the director of the INS testifying before Congress. But not exactly. Still definitely "on the record". And no one challenged or corrected the statement at the time or soon afterwards, as far as I know.
