His willingness to obey orders if only...is irrelevant. He has already missed movement and refused to obey the lawful order of his brigade commander. He is certainly guilty of both charges and there are no do-overs. Even if he was able to bring Obama's status into the court martial, and he won't, it will have no bearing on his offenses and the ultimate outcome of the trial.
